We strive to maintain accurate inventory levels on our Site. However, inventory availability is dynamic, and products may become out of stock after you place an order due to high demand. In the event that a product is unavailable after your order is submitted, we will notify you and:

  • Give you the option to wait for restocking (no estimated time guaranteed)
  • Suggest a similar product as a replacement
  • Cancel the affected item(s) and issue a refund to your original payment method

We are not liable for any consequential damages arising from product unavailability.

In the event of a typographical or pricing error on the Site, we reserve the right to correct the error and cancel or adjust any orders affected by the error. If we cancel your order due to a pricing error, we will refund the full amount paid.

7. SHIPPING AND DELIVERY

7.1 Shipping Destinations

Currently, we ship products exclusively to addresses within Canada. We do not fulfill orders to addresses outside Canada, including the United States or international destinations.

7.2 Processing Times

Orders are processed and packaged within 1–3 business days of order confirmation, excluding weekends and statutory holidays. You will receive a shipping confirmation email with tracking information once your order has been dispatched. During promotional periods, processing times may be extended due to volume.

7.3 Delivery Timeframes

Estimated delivery times are dependent on the shipping method selected:

  • Standard Shipping: 3–10 business days
  • Expedited Shipping: 1–3 business days (subject to availability)

These are estimates and not guarantees. Delays may occur due to weather, carrier issues, remote delivery areas, peak seasons, or other factors beyond our control. We are not liable for delivery delays or failures caused by carriers or events of force majeure.

7.4 Shipping Costs

Shipping costs are calculated at checkout based on your location, order weight, dimensions, and selected method. Where we offer free shipping promotions, such offers apply only to standard shipping within Canada and exclude bulky or oversized items.

7.5 Failed Deliveries

If a delivery fails due to incorrect address, recipient unavailability, or refusal to accept the package, the carrier will attempt redelivery or return the package to us. If the package is returned, we will contact you to arrange re-shipment at your expense. If you choose not to re-ship, a refund will be issued less original shipping charges and a restocking fee.

8. WARRANTY DISCLAIMERS AND LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZENCARTCANADA.COM, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • YOUR USE OF OR INABILITY TO USE THE SITE
  • ANY PRODUCTS PURCHASED THROUGH THE SITE
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

OUR TOTAL CUMULATIVE LIABILITY ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US FOR THE PRODUCTS THAT GAVE RISE TO THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER.

8.3 Consumer Protection

Some provinces do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so the above exclusions and limitations may not apply to you. In such cases, liability is limited to the fullest extent permitted by law.

11.3 Alternative Dispute Resolution

Prior to initiating legal proceedings, you agree to attempt to resolve disputes through good-faith negotiations with our customer service team. If resolution is not reached, the parties may agree to mediation or arbitration in Vancouver, BC, before filing suit.

12. SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remainder of these Terms and shall not affect the validity and enforceability of the remaining provisions. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy, Returns Policy, Shipping Policy, and any other policies referenced herein, constitute the entire agreement between you and ZenCartCanada.com regarding your use of the Site and your purchases, superseding any prior agreements, communications, or representations.
